Feb. 11, 1859 - "CUMBERLAND COUNTY, S.S. The Commonwealth of Pennsylvania, to the Sheriff of Cumberland county: WHEREAS, Caroline Nickle, by her next friend Conrad Hurd did on the Eleventh day of February 1859, prefer a petition to our said Judges of our Court of Common Pleas for the State of Pennsylvania, and County of Cumberland, praying for the causes therein set forth, that she might be divorced from the bonds of matrimony entered into with you John Nickel.We do therefore command you the said John Nickle that setting aside all other business and excuses whatsoever, you be and appear in your proper person before our Judges, at Carlisle, at a Court of Common Pleas there to be held for the County of Cumberland, on the Eleventh day of April next, to answer the petition or libel of the said Caroline Nickle and to show cause, if any you have, why the said Caroline Nickel should not be divorced from the bonds of matrimony agreeably to the Acts of General Assembly in such case made and provided.
Dec. 19, 1859 - "Deposition of witnesses produced sworn and examined by me the 19th day of December 1859: Nancy Moudy being duly sworn sayeth I am the wife of William Moudy formerly the Tavernkeeper in the Borough of Carlisle. I knew Caroline Swanger. She lived with me in 1856. She was hired by me to do housework. At the time Caroline Swanger lived at our house, John Nickle boarded at our house. John Nickle and Caroline Swanger were married at our house by Stephen Keepers Esq. John Nickle left after the night of their marriage and never stayed with her a night after that. He left this county and went to Chambersburg and left there and went west. Caroline had a child. She maintained her child and self by her own labours.
Dec. 19, 1859 - "Saha Humes sworn I have known Caroline Nickle. She was working as a servant at Dr. Lumases. She had a child called Laura Nickle. I became acquainted with her by her calling on me to board her child. I offered to board the child at one dollar per week. She said she was not able to pay that, that her
wages was not sufficient to pay one dollar per week but would give seventy five cents and I agreed to take and board the child for seventy five cents per week.Afterward I told her I could not afford to board the child for seventy five cents a week. She said she would give all her wages one dollar and that was all she had to depend upon. I boarded the child about three months prior to April 1859 and its mother paid me its board. I have no acquaintance with John Nickle. I never knew his wife to have any means of support only what she earned.
Dec. 19, 1859 - "Martha Beatman sworn I have known John Nickle and Caroline his wife. I knew them before they were married. Shortly after their marriage Nickle abandoned his wife. He left Carlisle and has not been back here since. Shortly after the abandonment and desertion of his wife by Nickle she went to her Grandmother Mrs. Swanger and was there confined. Sometime after her child was born she came to Carlisle and lived in the family with her child of Christian Long at fifty cents per veek. Four or five days before the death of Mrs. Long, she brought her child to me to board and I boarded her child, at seventy five cents per week and she went to Mrs. Irish at one dollar and twenty five cents per week. After she left Mrs. Irish she went to Dr. Loomases to live. From the time of her marriage up to the filing of this suit I know she received no support from her husband, but her means of living had for herself and child were earned by her. The child I boarded was called Laura Nickle. It must now be about three years old.
Dec. 20, 1859 - Subpoena in Divorce Now to wit 20th Dec. 1859, after hearing the evidence in this case and upon due consideration of the premises the Court doth hereby order and decree that the said Caroline Nickel be and she is hereof divorced from the bonds of matrimony entered into with the said John Nickel, and all and every the duties, rights and claims accruing to either of the said parties at any time heretofore in pursuance of their marriage shall cease and determine, and the said parties shall severally be at liberty to marry again in the like manner as if they never had been married.
